Was your Notice to Keeper late? The 14-day rule

Timing rules in POFA Schedule 4 decide whether the keeper can be held liable.

Camera (ANPR) charges, no windscreen ticket

The Notice to Keeper must be delivered within 14 days, starting the day after the parking period ended (para 9(5)).

Windscreen ticket first

The Notice to Keeper must be delivered in the 28 days that follow the first 28 days after the windscreen ticket. In practice, from day 29 to day 56 (para 8(5)).

Working out delivery

A posted notice is presumed delivered on the second working day after posting. Working days exclude Saturdays, Sundays and public holidays in England and Wales (paras 8(6) and 9(6)). The operator's date of posting is usually on the notice.

Example method

Parking ended Monday 2 March. The 14 days run from Tuesday 3 March to Monday 16 March. A notice posted on Friday 13 March is presumed delivered on Tuesday 17 March, which is late. Check bank holidays for your dates.

A late notice means the keeper is not liable under Schedule 4. It does not stop the operator pursuing the driver.

No guarantee of success. Outcomes depend on the facts, the evidence, the operator and the appeals body. If an appeal fails you may still have to pay, possibly without the early payment discount.
